Stockton-on-Tees Borough Council Event Trader Terms and Conditions
1. It is a requirement that all portable electrical equipment is tested prior to us allowing its use on our electricity supply, we will ask for a valid Portable Appliance Testing (PAT) certificate on your arrival.
2. It is a requirement of all traders that you adhere to all health and safety warnings and messages from Stockton-on-Tees Borough Council Event team and Event Control and that you act on these warnings accordingly.
3. It is a requirement that all necessary paperwork and documentation is in date and received in advance of the event. This includes a copy of your public and employers' liability insurance, evidence of food hygiene inspection and rating, method statement, risk assessment and Hazard Analysis and Critical Control Points (HACCP) documentation.
4. All equipment must be set up on site and ready for operation one hour before the starting time of the event, with access on the day of the event, staggered at your allocated times. Vehicle movement will not be permitted after the times stated in your trader pack, and under the direction of Event Control, until the event's conclusion.
All clearance for vehicle movement will come from Event Control and the Trader Liaison staff:
- all traders have allocated load-in times which must be followed
- there is strictly no trading on site prior to the event opening times
- in the instance of a sell-out, early departures will not be accommodated, ensure that you bring enough stock to operate the full trading hours
5. Equipment may only be dismantled after the closing time of the event or if specifically requested via Event Control.
6. It is a requirement that payment is received by the dates stipulated by the Event Organiser. Payment is non-refundable.
7. Vehicles will be prohibited from moving until the close of the event when the site is clear or closures have been lifted.
8. Traders must not:
- do anything which shall be in any way a nuisance or which in the opinion of the organisers' is contrary to either public good taste or the character of the event
- sell or display goods or services which have not been stipulated on the booking form and agreed by the organisers
- organise any form of betting or gambling
9. All bookings are accepted on the understanding that traders operate solely at their own risk. Where overnight security is in operation, the council shall not be held liable for any loss or damage to persons or property which traders sustain from any cause whatsoever, save in respect of death or personal injury caused through the negligence of the council, its servants, or agents.
10. Any damage caused by the trader or their agents to the fixtures or property belonging to the council or their agents shall immediately be made good at the trader's expense.
11. All traders shall indemnify the council against all liabilities, action costs, claims and compensation for injury or loss to any person or damage to or loss of any property arising as a result of their occupancy of an allotted space, or any act, omission or negligence done or omitted by the trader, their agents or any other person under their direction save in respect of death or personal injury caused through the negligence of the council, its servants or agents.
12. Each trader must be appropriately insured for all contingencies and must hold a general third party policy of insurance to cover public, legal and product liability.
Craft trader: £1,000,000.00
Food trader cover from £5,000,000.00
Current insurance policies and certificates must be produced to the council on request. Each trader or Event Organiser is to be responsible for any events booked by themselves for example, public liability insurance. Additionally, food traders must have a 4 star and above rating from their local authority Environmental Health Unit. The main event organiser will be responsible at all times for any attractions booked by themselves for their event. This condition is non-negotiable and applies at all times.
13. In the events of any abandonment, postponement or limitation of the use of the site or of any of the services provided therein, resulting from unforeseen circumstances or an intervention by an outside authority or found necessary by the council, traders shall have no claim against the council in respect of any resulting loss or damage and the traders liability under these conditions shall not be reduced.
14. You should not exceed the allotted boundaries of the event site or your cabin or unit, as stipulated by agreed site plan and Event Control.
15. The council reserves the right to allocate space, as it deems appropriate.
16. Traders must endeavour to follow the Environmental Pledge, as circulated by the Event Organiser.
17. All traders should use low-cost menus as pre-agreed with the Stockton-on-Tees Borough Council Event team.
18. Traders who fail to follow the guidance set out in these Terms and Conditions will risk their time trading on site being terminated with immediate effect, and the potential of further action being taken by Event Control.
19. Completion and submission of the terms and conditions will signify that that you are willing and able to follow this guidance.
