Saved and Deleted Local Plan Policies

We are currently undergoing a transition from the old system of Structure Plans and Local Plans to the new system of Regional Spatial Strategies (RSS) and Local Development Frameworks (LDF).

During the change from the old system to the new system it is important that we are not left without planning policy. Important policy from the old system has been saved until it is replaced by the new system.

The Planning and Compulsory Purchase Act 2004 enabled Local Planning Authorities with up-to-date development plans to seek approval from the Secretary of State for such plans to be 'saved' during the transitional period. This is why we have been able to continue using some policies in our 1997 Local Plan.

Alteration Number One to the Local Plan was adopted in March 2006 and was automatically saved for three years. After three years, the Secretary of State gave us permission to extend some policies beyond March 2009, until the adoption of replacement policy documents through the Local Development Framework.

When the Core Strategy (the first Development Plan Document produced under the Local Development Framework) was adopted in March 2010, it replaced some policies in the Local Plan and Alteration Number 1. Those policies have also been deleted and will no longer be used to determine planning applications.

Further policies in the Local Plan and Alteration Number 1 will be deleted as the Local Development Framework develops and further documents are adopted.

Tees Valley Structure Plan 2004

The Tees Valley Structure Plan (2004) was replaced by the Regional Spatial Strategy for the North East in July 2008.
