Liability Order

If the amount shown on the summons is not paid in full by the court date the Council will apply to the Magistrates Court for a liability order. This action will involve costs of £17.00 in addition to the £57.00 summons costs already added.

No further recovery action will be taken provided an agreed payment arrangement is kept. The liability order provides the Council with the following enforcement powers:

• Attachment of Earnings Order
• Deductions from Jobseekers Allowance or Income Support
• Bailiff action
• Proceedings for committal to prison
• Bankruptcy proceedings
• Charging Order against the taxpayers property
• Criminal proceedings will be taken against those taxpayers who fail to supply the appropriate employment or benefit details
